Update on SNAP Food Restriction Waivers Following Court Decision

On June 22, 2026, the US District Court for the District of Columbia ruled the United States Department of Agriculture's (USDA) approval of Nebraska's food restriction waivers be vacated.  Due to this court order, Nebraska Department of Health and Human Services (DHHS) is in the process of working with SNAP retailers to remove the restrictions on soda and energy drinks. Many retailers will require time to update their systems before the restrictions are lifted. DHHS will provide additional details at https://dhhs.ne.gov/Pages/Healthy-Choices-Waiver.aspx as information becomes available.
