What you need to know

​​​​​​​​​​​​​​Tanning Facilities are not licensed by Nebraska; however, there are several requirements that pertain to indoor tanning facilities.

Reminders:

  • It is against the law for any person under 16 years of age to use tanning equipment at the tanning facility unless the person is with his or her parent or legal guardian who has provided written consent for the minor to use the tanning equipment. The tanning facility must require proof of age (i.e.: driver's license or government-issued ID with date of birth and photo) from each person before allowing the person to use the tanning equipment.
  • All tanning facilities must post a warning sign where it is visible by any person entering the facility.

Complaints

The Department may inspect any tanning facility during the hours the facility is open to make sure the facility is in compliance with the minimum age requirement for tanning and has the required signage. Sanitation or other issues are not regulated by the Department.

Civil Penalty: Any tanning facility that allows a person under 16 years of age to use tanning equipment at the tanning facility without being with his or her parent or legal guardian who signed the consent is subject to a civil penalty of $100 by the Department of Health and Human Services (Nebraska).

Required Warning Sign

All tanning facilities must post a readily visible warning sign in the tanning facility. The warning sign must have black letters which are at least one-fourth inch in height.

The warning sign must include the following information:

  • DANGER — “Ultraviolet Radiation"
  • Follow instructions.
  • Avoid overexposure. As with natural sunlight, overexposure can cause eye and skin injuries and allergic reactions. Repeated exposure may cause premature aging of the skin and skin cancer.
  • WEAR PROTECTIVE EYEWEAR — Failure to do so may result in severe burns or long-term injury to eyes.
  • Medicines or cosmetics can increase your sensitivity to ultraviolet radiation. Consult your physician before using sunlamps if you are using medication or have a history of skin problems or believe yourself to be especially sensitive to sunlight. If you do not tan in the sun, you are unlikely to tan from the use of tanning equipment.
  • It is unlawful for a tanning facility to allow a person younger than 16 years of age to use tanning equipment without being accompanied by the person's parent or legal guardian.

Any person may report a violation of the Indoor Tanning Facility Act to the Department of Health and Human Services.
