What you need to know

​An application for an Intermediate Care Facility for Persons with Developmental Disabilities must meet the requirements in:

Initial License: An applicant for an initial license must:

  • Submit a completed written application
  • Submit the required documentation identified at 17-003.01A and 17-003.01B and fee; and
  • Pass an onsite inspection prior to client use and occupancy.

    NOTE:
  • An Intermediate Care Facility for Persons with Developmental Disabilities may not operate until the inspection has been completed and the DHHS Division of Public Health determines a license can be issued.
  • A change in location of the facility or change in ownership voids the current license and requires a new license to be issued prior to providing services.

License Renewal: Licenses of all Intermediate Care Facilities for Persons with Developmental Disabilities expire March 31st of each year and must be renewed to continue to operate. The renewal process is initiated by the DHHS Division of Public Health sending the licensee a written notice, no later than 30 days prior to the expiration date, of the license expiration and an application for renewal.

Duplicate License: A duplicate or reissued license is available by submitting a request in writing or using the Facility Reissue form and a $10 fee. 

Fees:  

Per 17-004.09 Fees, the licensee must pay the following fees for licensure and services: 

  • Initial and renewal licensure fees: 
    -  1 to 50 Beds $1,550
    -  51 to 100 Beds $1,750
    -  101 or more Beds $1,950
  • Duplicate license: $10
  • Refunds for denied applications:
    -  If the Department did not perform an inspection, the license fee is refunded except for an administrative fee of $25.
    -  If the Department performed an inspection, the license fee is not refunded.
