​​​​​​​​​​Past Public Comment Period for Family Support Waiver (FSW)

Pursuant to 42 C.F.R. §441.304(f), the Nebraska Department of Health and Human Services (DHHS) is required to give public notice related to the state's plan to implement a new 1915(c) Home and Community Based (HCBS) Family Support Waiver.   

APPROVED Family Support Waiver

The federal Centers for Medicare and Medicaid (CMS) approved Nebraska's new waiver on March 1, 2024. The new Family Support Waiver will begin serving people on March 1, 2024.

  • FSW Eligibility and Priority Brochure – A trifold brochure including eligibility requirements, DD Registry information, FSW funding priorities, and a flow-chart on the funding offer process.
  • FSW Services Quick Guide – Paragraph descriptions of each service available on this waiver, as well as a chart comparing to the services available on other DD Waivers. 

Submission to Centers for Medicare and Medicaid

DHHS submitted the waiver to the Centers for Medicare and Medicaid Services (CMS) on October 25, 2023.

The SECOND 30-day public comment period: September 8 through October 8, 2023.

Substantive changes to the waiver application were made, which required an additional public comment period. These changes included the removal of the Fiscal Management Service (FMS) from the waiver application, the removal of the waiver service titled Participant Directed Goods and Services, and changes to provider qualification training requirements.
