Department of Health and Human Services to Hold Hearings on Regulations November 4
Lincoln –The Nebraska Department of Health and Human Services is holding hearings November 4 in the Nebraska State Office Building, 301 Centennial Mall South, Lower Level, Conference Room A, Lincoln, Nebraska.
Public Hearing at 9:00 a.m. CT
The Division of Medicaid and Long-Term Care is holding this hearing to accept comments on proposed changes to regulations affecting Medicaid regulations. These changes will:
clarify that the date of payment for orthodontic treatment must occur after the orthodontist receives an approved prior authorization and the initial appliances have been placed: and
require that, if the client transfers to another dentist, the authorized dentist shall refund to Medicaid the portion of the amount paid by Medicaid that applies to the treatment not completed.

The Division of Medicaid and Long-Term Care is holding this hearing to accept comments on proposed changes to Medicaid regulations. The proposed changes will revise the outpatient hospital payment percentage for emergency room services, for new hospitals that provide outpatient hospital services, and for out-of-state hospitals that provide outpatient hospital services. Earlier this year, Medicaid payment for outpatient hospital services was decreased from 82.45% of the cost-to-charges ratio to 75%; changes for these three services were inadvertently omitted in the earlier regulation change.

The Division of Medicaid and Long-Term Care is holding this hearing to accept comments on proposed changes to Medicaid regulations for mental health and substance abuse community support services. The proposed changes will require billing in 15-minute units. A maximum of 144 units per 180 days may be authorized. The proposed changes will also revise Medicaid requirements for community support services for individuals with severe and persistent mental illness and incorporate similar Medicaid requirements for community support services for substance abuse treatment.

The Division of Developmental Disabilities (DDD) is holding this hearing to accept comments on proposed regulations for community-based services for individuals with developmental disabilities. Existing regulations regarding DDD-administered community-based services and Medicaid home and community-based waivers for persons with developmental disabilities will be repealed. The new regulations will cover eligibility and authorization, core requirements for specialized providers of services, individual support options, provider-operated community-based residential and day service options, respite services, non-specialized services, children’s waiver family services and specialized developmental disability provider contracting. The proposed regulations include the requirement of a lawful presence in the country and revise the administrative hearing section to give the Director of the Division of Developmental Disabilities the authority to make hearing decisions.
