Department of Health and Human Services to Hold Two Hearings on Medicaid Rates July 29 in Lincoln

Intermediate Care Facilities for Persons with Mental Retardation & Nursing Facility Services

Lincoln – The Department of Health and Human Services (DHHS), Division of Medicaid and Long-Term Care, is holding 2 hearings to accept comments on proposed changes to Medicaid regulations for determining payment rates for services provided by nursing facilities and intermediate care facilities for persons with mental retardation (ICF/MRs). The proposed rates will be available for review and comment at both public hearings, and are also available on the DHHS website at http://www.dhhs.ne.gov/Pages/reg_hearings.aspx. These hearings will be held July 29, 2010 at the State Office Building, Lower Level Conf. Room ‘A’, 301 Centennial Mall South, Lincoln, NE.

Public Hearing at 1:00 p.m. CDT

At this hearing proposed changes will establish Medicaid rates for services provided by ICF/MRs for the period of July 1, 2010 through June 30, 2011, with rebasing to the June 30, 2009 cost reports. The proposed changes will also:

  • Update rate period references and administrator maximums;
  • Revise the inflation factor language to describe the methodology but no longer specify the exact percentage. This change is designed to make this rate-setting process more timely and efficient; and
  • Revise the fee charged for a copy of a cost report, to comply with DHHS policy.

Public Hearing at 2:00 p.m. CDT

The proposed regulations also provide for the use of a more recent version of the federal government’s methodology for determining levels of care and the corresponding payment rates. Other proposed changes will:

  • Correct the swing bed payment methodology description to comply with the method described in Nebraska’s approved Medicaid State Plan and the method currently and historically used;
  • Add a definition and payment methodology for Indian Health Services nursing facilities;
  • Update rate period references and administrator maximums;
  • Revise the inflation factor language to describe the methodology but no longer specify the exact percentage. This change is designed to make this rate-setting process more timely and efficient; and
