Department of Health and Human Services to Hold Three Hearings August 19

Water Well Contractors, Water Operators & Behavioral Health Services


Lincoln –The Department of Health and Human Services (DHHS) is holding three hearings August 19, 2010 in the Nebraska State Office Building, 301 Centennial Mall South, Lower Level, Conference Room ‘A’, Lincoln, NE.

Public Hearing at 9:30 a.m. CDT

The DHHS Division of Public Health is holding this hearing to accept comments on proposed changes to regulations for Licensure under the Water Well Standards and Contractors’ Practice Act. These proposed changes will also implement provisions of the Uniform Credentialing Act. The proposed changes will:

  • Delineate processes for initially obtaining, renewing, reinstating, voluntary surrender or limitation of a credential;
  • Further delineate acts or behaviors considered unprofessional conduct;
  • Specify continuing competency requirements and circumstances for waiving them;
  • Add grounds for disciplinary action;
  • Provide for an administrative penalty when evidence exists that an individual has practiced a profession or occupation without a credential;
  • Require verification of lawful presence in the United States; and
  • Change the credentialing fee for each type of license to $150 biennially.

Public Hearing at 11:00 a.m. CDT

The DHHS Division of Public Health is holding this hearing to accept comments on proposed changes to regulations for licensure of water operators. These proposed changes implement provisions of the Uniform Credentialing Act, the Nebraska Safe Drinking Water Act, and make other revisions. The proposed changes will:

  • Delineate the processes for initially obtaining, renewing, reinstating, voluntary surrender or limitation of a credential;
  • Provide for an administrative penalty when evidence exists that an individual has practiced a profession or occupation without a credential;
  • Add grounds for disciplinary actions;
  • Delineate acts or behaviors considered unprofessional conduct;
  • Specify continuing competency requirements and circumstances for waiving them;
  • Increase the credentialing fees;
  • Require that the operator must re-take and re-pass an examination if the license has been expired or on inactive status for a period of two or more years, or the operator did not meet the requirements for continuing competency before each renewal period; and
  • Require verification of lawful presence in the United States.

Public Hearing at 1:30 p.m. CDT

The DHHS Division of Behavioral Health is holding this hearing to accept comments on proposed new regulations for behavioral health services and the repeal of Title 201, Certifying Compulsive Gambling Counselors; Title 203, Regulations for Organizing and Implementing Substance Abuse Services Under the Division on Alcoholism and Drug Abuse Act; and Title 204, Community Mental Health Programs. The proposed regulations will:

  • Implement provisions of the Nebraska Behavioral Health Services Act;
  • Combine all regulations for the behavioral health system into a new Title 206, which will govern community-based behavioral health services for individuals provided by the public behavioral health system; and
  • Incorporate key concepts of behavioral health reform to ensure that services are recovery-oriented, trauma-informed, and consumer-focused, and to ensure that services are provided in the most integrated setting appropriate for each consumer’s needs.
