Business Associate Agreement & Process

If you are Business Associate for the Nebraska DHHS (click here to see " Who is a Business Associate"), then you will need to sign a Business Associate Agreement, as required by HIPAA regulation.  Here are the process and reference files to prepare documents.

Part I.  The Process for Creating a BAA

  • Identification of mutual interest need; initiate discussions
  • Itemize needs for this relationship.
  • Draft Business Associate Agreement, using the template below, and make the customizing changes.
  • Signing the Agreement, by both sides' authorized representative.

Part II.  The Files for BAA

1. State of Nebraska, Master Interagency / Business Associate Agreement This version has been approved by the Legal department on 2/12/03.
2. Exhibit A -- Authorized Workforce Confidentiality Agreement These two (#2 and #3) attachments are a part of the entire Business Associate Agreement packet.
